PSO GmbH – Data Protection Policy

We respect your privacy and acknowledge our corporate responsibility to process your data with due care. This declaration is intended to provide you with a summary of how we collect and process your data. By this declaration you give your consent to the use of your data within the scope set out below. You are free to revoke your consent, in whole or in part, for the future at any time.

1. Field of application and basic principles

You can visit our website without disclosing any personal data. So unless you log in, using your user name and password, you remain anonymous.

To each customer that has registered with us we offer a password protected access to the customer’s data and purchase orders. This allows you to check the status of your purchase orders at any time and to administer your personal data.

We collect, archive and process your data for the purpose of processing your purchase orders, delivering products, carrying out services as well as processing payments. We use your data to administer your personal customer account, to communicate with you, to offer you interesting products and services, to improve our service and to adapt the same to the desire and needs of our customers, to identify malpractice, and to manage legal conflicts.

To the extent necessery, we communicate your data to the service providers we employ for the purpose of processing your purchase orders, e.g., to wholesalers, carriers and banks.

2.What personal data of the customer do we collect and use?

If you wish to purchase products or services via our platform, you need to communicate to us in particular your name, address, a telephone number for questions we may have as well as an e-mail address to communicate with you, e.g., to confirm receipt of your order. Other data you will provide us with can include your bank or credit card details, e-mails you send us as well as the contents of your wish list, your shopping cart and your feedback. In the event the buyer is not identical with the receiver of the purchased goods, we will need, in addition, the name, address, telephone number and e-mail address of the receiver to be able to properly ship the goods.

3.Data processing for advertising purposes

We use your data to keep you informed regarding our products and services and to recommend products and services to you. You can revoke your consent with the foregoing, at no cost, by following the link provided in the relevant marketing e-mail you received from us, or by sending an e-mail to info@pso.de. Further, you will not receive our newsletter unless you sign up for it and give us confirmation by following the relevant link in our e-mail (double-opt-in).

4.Other fields of application

Each time you purchase, search, evaluate, provide feedback, participate in a lottery or compile a wish list or fill your shopping cart via our website, or if you communicate with our customer service, you automatically provide us with certain information that our systems archive. For example, your IP address and domain name as well as certain non-personal data such as the browser type you use will be archived. We also record passwords and transactions completed in the past. In addition, data entries made by you may be recorded in order to statistically analyse user habits, or to commission a third party with such analysis.

5.Collection of data using cookies

We make use of cookies in our websites. Cookies are small pieces of text stored on your computer by your web browser. Cookies record certain settings and data regarding the exchange of information between your browser and our system. These recordings facilitate your use of our website as they render it unnecessery to repeat settings and certain other data entries, and they allow us to customize our website in accordance with customer behavior. Please note that a cookie can not read and/or record any data from your computer that you had not previously communicated to us. Also note that no other company than ours uses any of our cookies.

It is in your sole discretion to accept or not accept cookies, as well as to delete existing cookies, by changing the relevant settings of your browser. You are not required to accept cookies to be able to visit our website and to take a look at our offer. However, certain of our website’s functionalities, such as the shopping cart and the wish list, will not be available for use if your browser’s settings do not accept cookies. This is why we recommend you to accept cookies.

Furthermore, we use Google Analytics for our website. By visiting our website you agree to the collection and processing of data by Google as described herein below. Google Analytics uses cookies that allow for an analysis of your use of our website. Google records this information (including your IP address) on a Google server based in the USA. On the basis of this information Google files reports on your use of our website and provides us with other internet services in connection therewith. Goolge will communicate this data to third parties to the extent such third parties process the data on Google’s behalf or to the extent required by law. Google has committed itself to observe the “US Safe Harbor” privacy regulations.

6.Do we communicate your data to third parties?

We do not sell customer data to third parties. We communicate such data to third parties only to the extent as described herein.

We communicate customer data to an affiliated company if this is necessary to process the transaction, provided that the affiliated company will also be bound by this data protection policy.

For some of the tasks that need to be accomplished during the transaction we will commission third party service providers, such as for logistics, payment, debt collection, customer service, credit assessment and advertising. To enable these service providers to accomplish their task, and only to the extent necessary, we provide them with access to customer data and information. We will nevertheless remain fully responsible for the observance of the regulations set out in this data protection policy.

Subject to the foregoing, we will not disclose any customer data, unless (i) we are legally required to do so, (ii) it is necessary to legally enforce any rights we may have, or (iii) you give us your approval for the disclosure.

7.Transmission of data

To protect your data from unauthorized disclosure, transmission will be encrypted using the encoding system Secure Sockets Layer (SSL).

8.Third party advertising

Where our website includes third party advertising and links to third party websites, we do not adopt their contents as our own and we will not be responsible for such contents. We will not disclose any customer data to such third parties. Their websites and contents may be subject to their own applicable data protection policies.

9.Social Plugins

To the extent our websites use social plugins, such as from Facebook, your browser will connect with the relevant website (e.g., Facebook’s) once you click on the plugin. By doing so, Facebook will be informed that you have visited our website prior to being forwarded to the Facebook website. If you use the plugin, certain information will be transferred to, and archived by, Facebook (e.g., “I like”, etc.). Any such transfer of information will be subject to the data protection policy of Facebook or that other social network, if applicable. You can prevent such transfer of information by logging out of the relevant social network.

10. Lotteries

In the event we organize a lottery, we will use customer data to notify the winner and to promote our offers. Any lottery will be subject to its respective general terms and conditions.

11. Credit assessment

To protect ourselves from malpractice, we reserve the right to communicate customer data (including the address) to third party service providers that specialize in credit assessment. The likelihood of non-payment, as calculated by such service provider, may have an influence on what payment options will be offered to you (e.g., whether or not we will be willing to perform prior to receipt of payment).

12. Disclosure of customer data upon breach of contract by the customer

If the customer breaches any of its obligations under the contract, we may, where allowed by law, communicate the customer’s data to credit reporting agencies and commission a collecting agency to collect overdue payments. The credit reporting agency may in turn use the data, where legitimate, to file credit reports to its clients, including a calculation on the likelihood of non-payment. In addition, we reserve the right to disclose the customer’s data to the competent authorities in the event we have reason to believe that a criminal offense has been committed.

13. User name and password are confidential

The customer agrees to treat user name and password confidential and to refrain from disclosing the same to any unauthorized person. Please note that you put the security of your data at risk each time you allow any third party access to your user name and password. We assume no liability in the event your user name and password were used without authorization, unless we are responsible for such abuse.

14. Modifications to this data protection policy

We reserve the right to modify this data protection policy and to inform you hereof in such event. However, no such modification has any influence on the consent given by you in the past on how we may you your customer data. We recommend that you re-read this data protection policy from time to time to take notice of any modifications made to it.

15. What are the customer’s options?

According to the German data protection regulations, you have the right to (i) request any information, at no costs, over what archived data we dispose of in relation to you and (ii) to request correction, blocking and deletion of your data.
